Builders + Backers Affiliate Program Terms

Effective Date: September 1, 2025

Binding Agreement

By signing up with the Builders + Backers ("www.buildersandbackers.com", "builders + backers", "we", "us" and "our") Affiliate Program ("Program"), you agree to be bound by these Terms and Conditions ("Agreement"). You hereby agree that you have read and understood all the clauses of this Agreement and agree to be bound by all terms and conditions herein.

You ("You", "Affiliate", or "Affiliates") agree that this Agreement is enforceable like any written negotiated agreement signed by you.

By clicking the button "Sign up" during registration on our Platform, you represent that you are over 18 years old and agree to the terms of our Privacy and Cookies Policy and this Agreement. If you are acting on behalf of a company, you declare to be authorized to perform such legal actions on behalf of that company.

Builders + Backers reserves the right to approve or reject any Program application at its sole discretion.

Account Requirements

  • Provide legal full name, valid email address, and requested information

  • Maintain account security (you're liable for security failures)

  • One account per legal entity unless authorized

  • Responsible for all account activity

  • No illegal or unauthorized use

  • No self-referrals or personal discounts

  • All sales must be arm's length transactions

Marketing Guidelines

Prohibited Activities

  • No paid advertising with affiliate links (Google Ads, Facebook Ads, Instagram Ads, etc.)

  • No bidding on our brand keywords: buildersandbackers.com, builders and backers, or variations

  • No deceptive practices: typosquatting, doorway pages, cookie stuffing, parasiteware

  • No unauthorized software: toolbars, browser extensions, pop-ups/unders

  • No IFrames, hidden links, or automatic redirects

Permitted Activities

  • Blog reviews and YouTube content

  • Social media sharing

  • Email marketing (must comply with CAN-SPAM)

  • Banner placement on your owned websites

Violations result in immediate termination and forfeiture of all commissions.

Commissions and Payment

Earning Structure

  • Commission on subscription revenue only (non-subscription services excluded)

  • Customer must not cancel within 30 days

  • Commission percentage as notified by Builders + Backers

Payment Terms

  • Approved if valid one month after sale

  • Paid 30 days after generation

  • Methods: Bank transfer or PayPal (varies by location)

  • Minimum payout threshold applies

  • Accounts inactive 6+ months forfeit unpaid commissions below threshold

Important Conditions

  • Refunded sales void commission (must repay if already paid)

  • Prior client referrals subject to manual review

  • No coupon/rebate sites accepted

  • We may request KYC documentation

  • You're responsible for all taxes

  • We may withhold suspicious payments pending investigation

Your Responsibilities

You are solely responsible for:

  • Technical operation of your site

  • Ensuring content doesn't violate third-party rights

  • Compliance with all applicable laws including:

    • FTC guidelines

    • CAN-SPAM Act

    • e-Privacy Directive

    • Copyright and trademark laws

  • Proper disclosure of affiliate relationship

  • Privacy policy disclosing data collection practices

Intellectual Property

  • Limited, revocable license to use our promotional materials

  • Must follow brand guidelines

  • Cannot misrepresent relationship with Builders + Backers

  • Cannot imply we endorse, sponsor, or are affiliated beyond this Program

Termination

We may terminate your account for:

  • Policy violations or false claims

  • Spam or illegal activities

  • Intellectual property violations

  • Fraudulent transactions

  • Brand damage concerns

  • Any reason at our sole discretion

Termination results in forfeiture of all unpaid commissions.

Legal Terms

Relationship

You're an independent contractor. No partnership, joint venture, agency, or employment relationship is created.

Liability

  • Not liable for tracking failures or indirect damages

  • Maximum liability: 6 months of commissions

  • No liability for lost revenue, profits, or consequential damages

Audit Rights

We may audit your records. Misrepresentation requires repayment with interest. Overpayments of 3%+ require reimbursement of audit costs.

Dispute Resolution

Disputes first go to senior management. If unresolved in 10 business days, proceed to binding arbitration (American Arbitration Association). This Agreement is governed by the laws of the United States and the State of Virginia. Jurisdiction and venue in Arlington County, Virginia.

Modifications

We may update these terms. Material changes require 30 days' notice. Continued participation constitutes acceptance.

Non-Disparagement

You agree not to make false, misleading, or disparaging statements about Builders + Backers, its products, services, or personnel.

Electronic Signature

Completing the application process creates an electronic signature binding you to this Agreement.
